I hereby release and hold harmless East Bay Musical Society, its officers, and its contracted staff, as well as any person or business with whom they may contract from any and all claims, damages, liabilities, losses or injuries to or by me arising from my participation in the stage production, it's auditions, rehearsals, and shows sponsored by East Bay Musical Society. This release, notwithstanding Section 1542 of the California Civil Code which provides "a general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known to him must have materially affected his settlement with debtor", releases all claims for injuries, damage, or loss to my person or property, real or personal, whether known or unknown, foreseen, unforeseen, patent, or latent, which I may have against East Bay Musical Society, its officers, and its contracted staff, as well as any person or business with whom they may contract arising from the subject matter of the above-cited action. I understand and acknowledge the significance of such specific waiver of Section 1542, and hereby relieve East Bay Musical Society, its officers, its contracted staff, as well as any person or business with whom they may contract from any responsibility to me for any damages, injuries or losses that I may incur from my participation in the above cited activity.
In case of emergency, I understand that every effort will be made to contact the Primary and Secondary Emergency Contact. In the event that they cannot be reached, I give permission to the physician selected by EBMS to hospitalize, secure proper treatment for, and/or to order anesthesia or surgery for myself/my child. I understand that I am financially responsible for any expense for medical and/or transportation on my behalf/my child’s behalf. I hereby release EBMS, its employees, and volunteers from any responsibility for injuries or illness occurring as a result of/or coincidental to my/my child’s participation in the program.
I hereby grant permission to East Bay Musical Society (EBMS) to use my/my child’s image, photo, likeness and/or voice recording on their website, multimedia, social media website, or in an official organization printed publications. I also acknowledge that EBMS may choose not to use my/my child’s image, photo, likeness at this time, but may do so at its own discretion at a later date. I understand that full names and personal information of myself/my child will not be published with the photo or recording.
I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing. I further acknowledge that East Bay Musical Society has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19. I further acknowledge that East Bay Musical Society cannot guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others. I voluntarily seek services provided by East Bay Musical Society and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending rehearsals, performances, and other gatherings.
I hereby release and agree to hold East Bay Musical Society harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of East Bay Musical Society, or that may otherwise arise in any way in connection with any services received from East Bay Musical Society. I understand that this release discharges East Bay Musical Society from any liability or claim that I, my heirs, or any personal representatives may have against the salon with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from East Bay Musical Society. This liability waiver and release extends to the organization together with all owners, partners, and employees.
